Terms & Conditions

1. Scope of Services

Tech Pros Texas provides on-site and remote technology installation, configuration, and troubleshooting services. We agree to perform the work described in the estimate or work order in a professional, workmanlike manner.

Exclusions: We do not guarantee the performance of the internet service provided by your ISP (e.g., Comcast, AT&T) or the manufacturing quality of third-party hardware.

2. Estimates and Authorization

Estimates: Any price estimate provided is an approximation based on the visible scope of work. If unforeseen circumstances arise (e.g., incompatible wiring, hidden structural issues), we reserve the right to cease work and provide a revised estimate.

Change Orders: Any deviation from the original scope of work requested by the Customer must be agreed upon in writing (text/email suffices) and may result in additional charges.

3. Payment Terms (Texas Prompt Payment)

Due Date: Payment is due in full immediately upon completion of services unless prior credit terms have been arranged.

Late Fees: Pursuant to Texas law, past-due balances will incur a finance charge of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.

Deposits: For projects requiring significant hardware procurement (over $500), a non-refundable deposit for the cost of hardware is required prior to scheduling.

Mechanic’s Lien Warning: UNDER TEXAS PROPERTY CODE CHAPTER 53, IF A BILL IS NOT PAID, WE RESERVE THE RIGHT TO FILE A MECHANIC’S LIEN AGAINST YOUR PROPERTY TO SECURE PAYMENT.

4. Access, Safety, and Site Conditions

Access: You agree to provide our technicians with safe and clear access to the property and the equipment.

Adult Presence: An adult (18+) must be present at the property for the duration of the service call if a minor is present.

Pets & Minors: For safety and liability reasons, you agree to secure all pets and keep minors away from the workspace. We are not liable for stress or injury to unsecured pets.

Hazardous Conditions: If our technician discovers hazardous conditions (e.g., asbestos, severe pest infestation, exposed high-voltage wiring), we reserve the right to vacate the premises immediately. You will be billed a trip charge.

5. Scheduling and Cancellations

Cancellation Policy: You must provide at least 48 hours' notice to cancel or reschedule an appointment.

Kill Fee: Cancellations made with less than 48 hours' notice, or "No Shows" (where our technician arrives and cannot access the property), will incur a $45 Service Call Fee.

6. Limited Warranty

Labor Warranty: We warrant our installation workmanship to be free from defects for a period of 30 days from the date of service. If a workmanship issue arises, we will return to correct it at no cost.

Hardware Warranty: WE DO NOT MANUFACTURE EQUIPMENT. Any hardware installed is subject solely to the manufacturer’s warranty. We will assist in facilitating a warranty claim within the first 30 days, but we are not responsible for hardware failure.

No "Software" Warranty: We do not warrant against software bugs, updates that break functionality, or malware infections occurring after our service.

7. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, ALL SERVICES AND PRODUCTS ARE PROVIDED "AS IS." WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. LIMITATION OF LIABILITY (Review Carefully)

IN NO EVENT SHALL TECH PROS TEXAS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST DATA, LOST PROFITS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tech Pros Texas and its employees from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

Your violation of these Terms;

Your negligence or misconduct;

Defective equipment provided by you for installation.

10. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the courts of Montgomery County, Texas (or the county in which the work was performed, at our discretion).

11. Dispute Resolution

In the event of a dispute, the parties agree to attempt to resolve the matter in good faith for a period of 30 days. If unresolved, the dispute shall be resolved via binding arbitration in accordance with the rules of the American Arbitration Association, held in Conroe, Texas.
